The matters abovementioned were listed before the Ld. Registrar on 21.01.2016, when he interalia pleased to pass the following order:

"Civil Appeal No (s). 6576-6579/2014

Four weeks time, as last chance is given to the learned counsel for the appellant to comply with the terms of the order dated 13.10.2015 of this Court in respect of Respondent Nos. 27, 34, 69, 73, 76 and 83. xxxxxxxxxxxxxxxxxxxxxxxx."

It is submitted that counsel for appellant has not complied with the order dated 13.10.2015 as he has not filed application for substitution to bring on record Lrs. of deceased Respondent Nos. 27, 34 & 69 and has also not furnished the fresh address of Respondent Nos. 73, 76 and 83 alongwith copy of pleadings. Therefore notice could not be issued to Respondent Nos. 73, 76 & 83.

C.A. Nos. 65806583 of 2014

It is submitted that counsel for the Appellant has not taken appropriate steps to provide fresh address in respect of Respondent Nos. 14, 34, 44, 45, 46, 54, 56, 57, 64, 68, 80, 84, 100 and 102 and also not filed application for substitution to bring on record the Lrs. of deceased Respondent No. 73 so far.

Service is not complete on Respondent Nos. 14, 34, 44, 45, 46, 54, 56, 57, 64, 68, 80, 84, 100 and 102.

C.A. Nos. 65846587 of 2014

It is submitted that there are 57 Respondents. Respondent Nos. 6 & 36 unserved as per certificate of service received from High Court stating therein that Respondent No. 6 "shifted to new premises" and Respondent No. 36 "Retired from service."

Service is not complete on Respondent Nos. 6 & 36.

C.A. Nos. 65886591 of 2014

It is submitted that certificate of service has been received from the High Court stating therein that Respondent Nos. 33, 46, 64, 67, 126, 130, 131 and 134 "Retired from service" and Respondent Nos. 53, 72 with remarks "No such person and no such evening branch in the given address" and Respondent No. 115 with remarks "Now working at KS.CB, Head Office, Thiruvananthapuram" and are unserved. Counsel for the Appellant was requested vide Registry's letter dated 05.02.2016 to take appropriate steps but he has not done the needful so far.

The matters abovementioned are listed before the Ld. Registrar with this office report.
