UPON hearing counsel the Court made the following O R D E R SLP(C) NO.17073/2013 Duly represented respondent Nos. 1 to 3,8,11,12,14,15,21,27,30,32,34,39, 44, 45, 46, 48, 50,52 are granted four weeks' time as final chance for filing counter affidavit, subject to the ld. Counsel for the -2- Item No.60 petitioner serving the complete set of pleadings on the other side and necessary proof of service be filed in a weeks' time on record. Counter affidavit on behalf of respondent Nos. 6,10,16,26,29 and 35 has already come on record. However, vakalatnama and counter affidavit are reported to be suffering from certain defects and the ld. Counsel Mr K.L.Janjani has undertaken to cure those defects in two weeks' time. He has also accepted notice on behalf of respondent No.9 and undertaken to file vakalatnama and counter affidavit by next date. Four weeks' time is granted. It appears that counter affidavit has been also filed on behalf of respondent Nos. 21,30,39,50,51 and 46 by the ld. Counsel, Mr Balaji Srinivasan and Mr Ashwani Kumar but the copy has not been served on the other side. Omission be rectified by next date.

Similarly, there seems to be some defects/errors in the vakalatnama filed by the ld. Counsel, Mr P.N.Puri for respondent No.38. Same be cured by next date positively failing which further necessary orders as per rules shall be passed.

Status of the respondents as shown in the tabular chart indicates that some of the respondents as reflected in Col. 4 of the chart have been duly served but none appeared on their behalf (barring respondent Nos. 9 and 38).

-3- Item No.60 Col. 5 indicates the number of respondents who are yet to be served for want of spare copies. The ld counsel for the petitioner to supply the omissions within three weeks and on compliance notices be issued forthwith through the concerned District Court in addition to postal service. SLP(C) NO.17074/2013 Respondent Nos. 2,3 and 21 are granted four weeks' time for filing counter affidavit. Respondent Nos. 4,5,13 and 16 are reported to be duly served through post but none appeared on their behalf. Notices be re issued to respondent Nos. 1,6 to 12,14,15 ,17 to 20 and 22 through the concerned District Court in addition to postal service. List again on 28.10.2013.
