Shri Basava Prabhu Patil, learned senior counsel appearing for the petitioner seeks leave of this Court to withdraw the Special Leave Petition with liberty to file an appropriate Review Petition before the High Court for modification/review of the orders passed on 14.12.2011. Permission sought for is granted and the Special Leave Petition is disposed of as withdrawn. We add that the learned counsel submits that the legal representatives/heirs of Defendants no.2 and 3 were never appointed as Receivers by an appropriate Court orders. This aspect of the matter can also be brought to

: 2 : the notice of the High Court. He is also permitted to raise all such issues which are available to him, including the issues raised in this Special Leave Petition while filing the Review Petition.
