The matter above mentioned has been filed against the Judgment and Order dated 10th November, 2011 passed by the High Court of Judicature at Madras in S.A. No. 1917 of 1991.
It is submitted that there are 20 Respondents. In respect of respondent Nos. 4, 5, 7, 8, 10, 16, 17 certificate of service has been received from the High Court. Respondent Nos. 12 and 19 are represented by M/s. Parekh and Company, Advocates. In respect of respondent Nos. 1 to 3, 6, 9, 11, 13, 14, 15, 18 and 20. Certificate of service has been received from the High Court with the remarks '(dead)' but counsel for the appellant has not taken any steps in respect of deceased respondents.
Service is complete.
Original record has been returned back to the High Court in terms of circular dated 4th December, 2014.
It is further submitted that counsel for the parties have not filed statement of cases and in terms of Order XIX Rule 32(2) Supreme Court Rules, 2013, and its proviso, where the parties do not file statement of cases within the time prescribed, it shall be presumed that the parties do not desire to file statement of cases and they have adopted list of dates/synopsis as statement of cases.
The matter above mentioned is listed before the Ld. Registrar's Court with this office report as pre final hearing.
