However, it goes without saying and even as observed by the NCLAT, the proceedings under Section 7 of the Insolvency and Bankruptcy Code, 2016 (for short 'IBC') shall be decided in accordance with law and on its own merits and all the contentions which may be available to the respective parties are kept open to be considered in the proceedings under Section 7 of the IBC.
