The matter abovementioned was listed before the Hon'ble Court on 10.07.2015 when the Court was pleased to pass the following order:

"Delay condoned. Issue notice returnable in two weeks. Dasti, in addition, is permitted."

Accordingly showcause notice returnable for 03.8.2015 was issued on 13.07.2015 to all the seven respondents by registered AD post as well as dasti. Neither AD card nor unserved cover containing notice has been received back from respondent Nos 1 to 4 & 7.

It is submitted that Mr. Shekhar Kumar, advocate has on 24.7.2014 filed affidavit of dasti service with proof stating therein that respondent nos. 1 to 6 are served and respondent No.7 is a proforma respondent, could not be served as he is not available at his address.

It is further submitted that M/s Parekh & Co. has on 31.07.2015 filed Vakalatnama on behalf of respondent Nos. 5 and 6.

service of notice is complete through Dasti service on all respondent except respondent No.7 (Proforma respondent).

The matter is listed before the Hon'ble Court with this office report.
