These matters have been placed before the Court. In the main appeals an order was passed on 04.01.2010 to the following effect:

"Issue notice regarding delay and on the SLP.

Mr. Hardeep Singh Anand, learned counsel appears for Respondent No.1.

Interim stay of the impugned orders of the High court subject to petitioner depositing before this court, one-third of the total compensation received less Rs.2,50,000/-(Rupees Two Lakhs Fifty Thousand only) within three months. The amount as and when deposited shall be invested in a fixed deposit for a period of one year renewable till disposal."

The appeals subsequently has been dismissed for non-prosecution. The judgment of the High Court dated 02.09.2008, against which these appeals were filed, directed that appellant shall pay 1/3rd of the amount of compensation received by him from the Land Acquisition Collector including the interest, if any, within a period of two months to the contesting respondent. aforesaid judgment, the appellant aggrieved, has filed these appeals when conditional interim order was passed on 04.01.2010.

In view of the fact that the decree was stayed on the condition of deposit, as directed on 04.01.2010, after dismissal of the appeals, the said amount has to be disbursed towards satisfaction of the decree. Let the amount, which is laying down with the Registry, be released in favour of the respondent no.1-Jai Singh, the contesting respondent.

The matters are disposed of accordingly.
