UPON hearing the counsel the Court made the following O R D E R

1 During the course of the hearing, the Court has been apprised of the fact that a Special Leave Petition being Petition for Special Leave to Appeal (Civil) No 28535 of

2019 against the judgment of the Gujarat High Court dated 16 September 2019 arising out of SCA No 3099 of 2005, was dismissed by this Court on 13 December 2019.

• 2 The learned Solicitor General is permitted on his request to file an affidavit explaining whether and if so, how the facts of the present case are different from those which arose in the Special Leave Petition which has been dismissed. The affidavit shall be filed within a period of three weeks from today.
• 3 The paper book of the earlier proceedings [SLP(C) No 28535/2019] shall also be placed before this Court on the next date of listing.
• 4 List the Special Leave Petition on 14 August 2020.
