The respondent applicant was terminated from service which order was set aside and de novo inquiry from that stage was ordered to be held meaning thereby that the contesting respondent shall be treated to be under suspension and, therefore, he is entitled for subsistence allowance in accordance with the statutory provisions. In this view of the matter, we direct the appellants to pay subsistence allowance in accordance with statutory provisions within a month from the receipt of the copy of this order and continue to pay the same till the disposal of the Civil Appeal.
