The matters above mentioned were listed before the Hon'ble Court on 28.4.2014 when the Court was pleased to pass the following Order:

"Delay condoned. Issue notice."

There is Sole respondent in the matter and service of Show Cause notice is Complete by way of Vakalatnama and memo of Appearance filed by R.U.Upadhyay, Advocate on behalf of sole responedent.

It is submitted that Counsel for sole respondent has filed Counter Affidavit but the same could not be taken of record being defective for the reason that counter has been filed on behalf of respondent no. 2 and 3 whereas there is sole respondent in this matter.

The matter above mentioned was listed before the Court of Ld. Registrar on 25.3.2015 when the following Order was passed:

"Counter Affidavit by the sole respondent has been filed.." However, it is defective. Defects be cured within a weeks. Matter thereafter be precessed for listing before the Hon'ble Court as per rules."

It is lastly submitted that Counsel for respondent has not cured the defects in Counter Affidavit so far. However the counter affidavit is circulated herewith for kind perusal of the Hon'ble Court.

The matter above mentioned is listed before the Hon'ble Court with this office report.
