The matter above mentioned alongwith connected matter was listed before the Ld. Registrar's Court on 05.07.2016, when inter alia following Order was passed:

"...SLP(C) No.19813/2011

Await the return of service of notice already issued to the respondent No.1. List the matter again on 12.08.2016."

It is submitted that fresh show cause notice to unserved respondent no.1 by Regd. A.D post was issued on 04.05.2016. Neither A.D. card nor unserved cover containing notice has been received back so far.

Service of show cause notice is not complete on Respondent No. 1.

The matter above mentioned was listed before the Hon'ble Court on 10.12.2012, when the Court was pleased to pass the following order:

" Post along with SLP(C) No. 2809 of 2011."

It is submitted that in terms of Hon'ble Court's order dated 10.12.2012, in instant matter has been tagged with SLP (C) No. 2809/2011. The Hon'ble Court has not directed show cause notice.

It is further submitted that Ms. Sandhiya Goswami, Counsel for the petitioner has expired and an alternative arrangement notice was issued to all the three petitioners on 02.05.2016. Mr. Sachin Patil, Advocate has on 02.07.2016 filed Vakalatnama & Memo of Appearance alongwith Death certificate of petitioner no. 3 namely Ms. D.R. Gupta and copy of original Will dated 24.07.2010, but Counsel has not filed application for substitution of deceased petitioner no. 3 so far despite this Registry's letter dated 09.07.2016.

The matters, above mentioned, are listed before the Ld. Registrar's Court with this office report.
