The matter abovementioned was listed before the Hon'ble Court on 22nd August, 2014, when the Court was pleased to pass the following order:

"Issue notice. Dasti, in addition, is allowed. Notice may also be served through the standing counsel. In the meanwhile, there will be stay of

further proceedings in the trial Court."

Accordingly show cause notice was issued to all the three respondents through registered AD post as well as by dasti mode.

It is submitted that Mr. D.K. Sinha, Advocate has filed vakalatnama/ appearance and reply affidavit on behalf of respondent no. 1. Mr. A.P. Mayee, Advocate has filed reply affidavit on behalf of respondent No. 2 but he has neither filed vakalatnama/ appearance on behalf of respondent No. 2 nor served copy of reply affidavit on M/s. D.K. Sinha and E.C. Agrawala on behalf of respondent no. 1 and 3 despite this Registry's letter dated 12th December, 2014. Mr. E.C. Agrawala has represented respondent No. 3. Copies of reply affidavit on behalf of respondent nos. 1 and 2 have already been included in the paper books.

It is further submitted that counsel for the petitioner has filed Affidavit of dasti service after serving of notice on all the three respondents. Therefore, service of show cause notice is complete.

The matter above mentioned is therefore listed before the Hon'ble Court with this office report.
