The matters abovementioned were listed before the Hon'ble Court on 10th August, 2016, when the Court was pleased to pass the following order:
"Delay is condoned, permission to file the Special Leave Petitions is granted and applications for impleadment are allowed in Special Leave Petition (Crl.) Nos.65756576 of 2014.
Ms. Meenakshi Arora, learned Senior counsel appearing for the petitioners in Special Leave Petition (Crl.) No.1503 of 2014 and the learned counsel appearing for the petitioner in Transfer Petition (Crl.) (D) No.7355 of 2014 state that the parties have arrived at a settlement and in support thereof, they have produced a copy of Memorandum of Understanding dated 9th August, 2016 entered into between M/s Hira Steel Limited through its authorized representative Mr. Diwesh Nath (First Party) and Mr. Prasanna Vasudev Ghotage, M/s. Coastal Mines and Minerals represented by Mr.Prasanna V. Ghotage and Upsurge Multitrade Private Limited (Second Party), which is taken on record.
The learned counsel appearing for the parties state that they will abide by the terms and conditions mentioned in the Memorandum of Understanding dated 9th August, 2016.
Ms. Meenakshi Arora, learned Senior counsel also state that Memorandum of Understanding dated 18th July, 2014 had already been entered into between M/s Hira Steels Limited through its authorized representative viz. Mr. Arun Poddar, Mr. J.P. Agrawal, Mr. Amit Agrawal, Mr. Alok Agrawal,
Mr. Pankaj Agrawal, Mr. Ajay Ahluwalia (First Party) and M/s. GeoChem Laboratories Pvt. Limited through its authorized representative viz. Mr. Vithal Shintre, Mr. Rajesh Bahl, Mr. Anish Bahl, Mr. Neel Bahl, Mr. Rajiv Bahl, Mr. Kshitej Bahl and Mr. Iqbal Khan (Second Party) which is on record.
Learned counsel appearing for the parties state that they will abide by the terms and conditions and take appropriate steps as contained in the Memorandum of Understanding dated 18th July, 2014.
In view of the above, the Special Leave Petitions are disposed of in terms of the interse compromise as contained in the above Memoranda of Understanding duly entered into between the parties.
However, we make it clear that if any other party has already filed any complaint in the matter, the same shall not be affected by the above Memoranda of Understanding.
The Memoranda of Understanding shall form part of this order.
Consequent upon the disposal of the Special Leave Petitions, pending applications filed in the matters are also disposed of."
It is submitted that counsel for the petitioner and respondent No 6 have jointly filed applications for modification of Court's Order dated 10th August, 2016. The said applications have been registered as Criminal Miscellaneous Petition Nos. 1561415615 of 2016. Paper books of Criminal Miscellaneous Petitions is placed along with Special Leave Petition Paper books as a separate volume.
The applications in the matters abovementioned were mentioned in the Hon'ble Court on 19th September, 2016, when the Court was pleased to pass the following order:
"As prayed, list the CRLMP on Friday, the 23rd September, 2016."
The applications in the matters above mentioned are, therefore, listed before the Hon'ble Court with this office report.
