It is submitted that Ms.Shilpa Singh, Advocate has filed Special Leave Petition on 18.2.2017 against the Judgment and Order dated 12.12.2016 of the High Court of Punjab and Haryana at Chandigarh in RFA No. 430/2016 alongwith application for permission to file Special Leave Petition.

It is further submitted that Counsel for petitioner has also filed an application for substitution to bring on record the Lrs. of deceased petitioner No. 1 namely Mohinder Singh which is barred by time by 402 days and Counsel has also filed an application for condonation of delay in filing substitution application with prayer for setting aside abatement.

It is further submitted that originally Special Leave Petition was within time but there is a delay of 3 days in refiling the Special Leave Petition.Counsel has filed application for condonation of delay in refiling the SLP in this regard.

It is further submitted that CC No. 2169/2017 Entitled Ashwani Kumar Vs. The Union of India and Ors. arising out of relied upon judgment was listed before the Hon'ble Court on 3.2.2017 when the court directed to list along with Civil Appeal Nos. 62896322 of 2008.(copy of order dated 3.2.2017 enclosed herewith).(Main matter C.A Nos.628963222/2008).

The matter is listed before the Hon'ble Court with this office report.
