UPON hearing the counsel the Court made the following O R D E R

IA No. 105828/2023 in Crl.A. No. 1249/2021

Vide order dated 22.05.2023, we have asked the report from the learned counsel representing the respondent who submitted its report.

As per the said report, the Medical Officer, Central Prison, Palayamcottai, has expressed concern regarding treatment but the prisoner voluntarily gave its willingness to undergo surgery in Tirunelveli Medical College Hospital. Learned counsel appearing for the petitioner contends that he has received the instructions from the prisoner that he wants to undergo the treatment in Multi Speciality Private Hospital. But to contradict the report of the Medical Officer, nothing is on record.

Considering the aforesaid, at present, we direct that as per the willingness of the prisoner, the treatment be provided by the jail authorities on government expenditure. It is, however, observed that in case, the petitioner is wiling to take the treatment in private hospital, he shall file an affidavit to the effect specifying the details of the hospital in which he wants to get the treatment. Needful be done within four weeks.
