The matter above-mentioned has been filed by Mr. Abhishek Chaudhary, Advocate, on behalf of the Petitioner against the Final Judgment and Order dated 22nd February, 2013 of the High Court of Judicature at Allahabad in Writ Tax No. 158 of 2013. There is delay of 853 days in filing and 56 days in refiling the SLP.
It is submitted that Special Leave Petition (Civil) No. 35682 of 2015 @ SLP (C) CC No. 21578 of 2015 arising out of similar issue was listed before the Hon'ble Court on 11th December, 2015 when the Hon'ble Court was pleased to direct issue notice and tag with SLP (C) No. 19445 of 2004 and the same is pending for hearing. Copy of the Record of proceedings dated 11th December, 2015 is enclosed herewith for the kind perusal of the Hon'ble Court.
It is further submitted that SLP (C) No. 11367 of 2007 referred to on Annexure 'P-9' was listed before the Hon'ble Court on 19th February, 2015 when the Hon'ble Court was pleased to dispose of the same as withdrawn. Copy of the Record of Proceedings dated 19th February, 2015 iis encosed herewith for the kind perusal of the Hon'ble Court.
The matter is listed before the Hon'ble Court with this Office Report Dated this the 22nd <sup>t</sup> Day of December, 2015.
