It appears from the Office Record that notice to the respondents was sent on 16. 1 2 . 2 0 0 6 by Registered Post A.D. However, neither A.D. card nor unserved envelope has been received back so far. In the said circumstances, the learned counsel for the petitioner has prayed for declaring that there is deemed service of notice on the said respondents. Since, neither the A.D. card nor the unserved envelope has been received back even after the period of 30 days, I am inclined to declare that there is deemed service of notice on the respondents in view of proviso to sub- rule (5) of Rule 9 of Order V of C.P.C. and Section 27 of the General Clauses Act. There is no appeara nce for the respondents.
