UPON hearing counsel the Court made the following O R D E R
The matter is pending for filing written statement by the defendant, Union of India since 8.8.2005. Time was also granted by this Court upto 13.10.2006. However, the matter might not have been listed because of the upper limit of number of cases to be listed before such Court and even after that, time of more than 2 weeks has passed, defendant has failed to file written statement. Today learned counsel Mr. T. S. Murthy appearing on behalf of Union of India, defendant No. 1 wants further 4 weeks time to file written statement as last and final opportunity. Learned counsel for the plaintiff is objecting to grant more time since the matter is pending for long period and requested to place the matter before the Hon'ble Court.
In view of the above facts, office is directed to list the matter before the Hon'ble Court, however, Union of India may file written statement as per rules before the matter is listed before the Hon'ble Court.
