It is submitted for information of the Hon'ble Court that the Special Leave Petition abovementioned is filed against the impugned Judgment and Order dated 22nd April, 2014 of the High Court of Delhi at New Delhi in ITA No. 152 of 2014 and is barred by time by 24 days. The Counsel for the Petitioner has filed Application for condonation of delay in filing Special Leave Petition.

It is further submitted for the information of the Hon'ble Court that Special Leave Petition Nos. 2436224363 of 2013 @CC Nos. 89118912 of 2013 entitled "C.I.T. vs M/S CALCUTTA EXPORT COMPANY" involving similar question of law is pending which was listed before the Hon'ble Court on 29th July, 2013 when the Hon'ble Court has directed to issue notice. (Copy of the Order dated 29th July, 2013 is annexed as Annexure P3 at page Nos. 112113 of the paper books.)

The office Report on default for not filing of Additional documents as per undertaking was listed before the Hon'ble Judgeinchamber on 8th May, 2015, when His Lordship was pleased to pass the following Order:

"Learned counsel for the petitioner states that she does not propose to file the additional documents. Registry to proceed further accordingly."

The matter alongwith application above mentioned is listed before the Hon'ble Court with this Office Report
