The abovementioned appeal alongwith other connected appeals was dismissed vide this Court's Order dated 05.05.2010.
It is submitted that application for direction (I.A. No. 43) filed by Mr. Praveen Swarup, Advocate on behalf of East Delhi MCD (responent No. 4) was listed before the Hon'ble Court on 20.03.2015 and again on 24.04.2015 when the Court was pleased to pass the following order:
"Since no relief is claimed against the State of Uttar Pradesh in the I.A., we direct the applicant to delete the name of the State of Uttar Pradesh from the array of parties. Reply, if any, to the application be filed in four weeks' time."
It is further submitted that in view of aforesaid order, no reply to I.A. No. 43 has not been filed so far.
It is further submitted that Mr. Praveen Swarup, Advocate on behalf of East Delhi MCD (respondent No. 4) has on 29.05.2015 filed an application for impleadment to implead UPSIDC as respondent (regd. as I.A. No. 44) and the same has been placed with appeal paper books. He has stated in paragraph 8 of the application that the State of U.P. was a party in the appeal.
It is further submitted that the State of U.P. was not a party in the appeal but the counsel has not cured the said defect so far despite this Registry's letter dated 05.06.2015.
It is lastly submitted that original appeal paper books have been weeded out and counsel for respondent No. 4 has not provided fresh complete set of appeal paper books despite this Registry's request.
The applications in the appeal abovementioned are listed before the Hon'ble Court with this Office Report.
