UPON hearing counsel the Court made the following O R D E R
I.A. No.22
Counsel for the MCD states that a cheque for Rs.19,78,00,000.00 was handed over to the contractor on 22nd March, 2006. Counsel appearing for the contractor

accepts that he has received the aforesaid cheque for Rs.19,78,00,000.00. The contractor has received a total sum of Rs. 70 crores towards the total work till date. Counsel appearing for the contractor undertakes to renew/revalidate the bank guarantee within ten days from today.
Counsel for the MCD is directed to finalise the bills already submitted by the contractor towards the arrears of all works, if not done already, within two weeks from today. Counsel for the MCD is further directed to place the order for the third part after finalising the rate/price within the next two weeks so that the project can be completed in time.
In the meantime, we direct the MCD as well as the contractor to immediately start with Civil, Electrical, Mechanical construction as also the Effluent Treatment Plant for installation of the plant which, as per counsel appearing for the contractor, has already been despatched on 19.3.2006 by M/s Banss International, Germany and which is likely to be received in India by 10.4.2006.
To come up on 20.4.2006 at 10.30 A.M. I.A. No. 36
We are not inclined to pass any order at this stage regarding the increase of capacity with regard to the construction of the modernized Abattoir because it would result in further delay in putting up the plant

as per sanctioned plan.
I.A. No. 36 is dismissed. However, after the completion of this plant, the applicant may move a fresh application, if so advised, which shall be considered at that time on its own merits.
