The application above-mentioned was listed before the Hon'ble Court on 10.03.2017 with office report dated 09.03.2017, when the Court was pleased to pass the following Order:-
"The instant order be read, in continuation of the motion Bench order passed by this Court on 23.02.2017. 2. We are informed by the learned counsel representing the UPSIDC, that a cheque in the sum of Rs.3,07,30,871/- (Rupees three crores, seven lacs, thirty thousand, eight hundred and seventy one only), was issued in the name of the East Delhi Municipal Corporation, on 27.02.2017. Learned counsel representing the East Delhi Municipal Corporation acknowledges the receipt and encashment of the above cheque.
3. The only issue, that remains to be adjudicated upon, is the compounding of interest, which is liable to be paid by the UPSIDC to the East Delhi Municipal Corporation. Before we can deal with the above issue, it is imperative for us to seek information from the UPSIDC, with respect to the transfer of the land, for which the refund has now been made, to third parties. Details thereof, including the consideration received in lieu of the allotment of the entire land in question, shall be furnished to this Court, by way of an affidavit, within two weeks from today. 4. Post for hearing thereafter."
It is submitted that in terms of afore-said Order, counsel for the UPSIDC has not filed affidavit in question so far.
It is further submitted that paper books of the appeal has been weeded out and fresh appeal paper books has been filed and placed before the Hon'ble Court.
The aforesaid application in the matter above-mentioned is listed before the Hon'ble Court with this Office Report.
