The application above-mentioned was listed before the Hon'ble Court on 23.02.2017 with office report dated 22.02.2017, when the Court was pleased to pass the following Order:-
**"**1. Heard learned counsel for the rival parties. 2. It is not a matter of dispute, that the East Delhi Municipal Corporation surrendered the land in the year 2003, for which the UPSIDC had been paid a sum of Rs.3,07,30,871/- (Rupees three crore, seven lacs, thirty thousand, eight hundred and seventy one only). Despite having taken possession of the land, as far back as in the year 2003, the principal amount, mentioned above, has still not been refunded by the UPSIDC, to the East Delhi Municipal Corporation. We hereby direct the UPSIDC, to issue a cheque in the sum of Rs.3,07,30,871/- (Rupees three crore, seven lacs, thirty thousand, eight hundred and seventy one only), to the East Delhi Municipal Corporation, within one week from today.
3. Post for hearing after one week.
4. In case, the aforesaid cheque is not issued, or in case the aforesaid cheque is not honoured, the Managing Director of the UPSIDC shall remain present in Court in person on the next date of hearing."
It is submitted that in terms of afore-said Order, a certified copy of the record of proceedings dated 23.02.2017 has been issued to the High Court of Delhi as well as the Managing Director, UPSIDC vide this Registry's letter dated 25.02.2017 for compliance. Pursuance to order dated 23.02.2017 counsel for the parties has not filed any compliance report in this Registry.
It is further submitted that paper books of the appeal has been weeded out and fresh appeal paper books has been filed and placed before the Hon'ble Court.
The aforesaid application in the matter above-mentioned is listed before the Hon'ble Court with this Office Report.
