UPON hearing the counsel, the Court made the following O R D E R
Ld. counsel for respondent nos.2 and 56 other respondents submits that the office report indicates his appearance on behalf of respondent nos. 24 and 84 which is factually incorrect. Office shall verify and update the same.
Respondent nos. 2 to 5, 7,8,11,12,15 to 19, 22,23,24,25,27 to 37, 40 to 42, 45,48,49,51,53,54,56,57,59,60,63,64,68, 69,70,73,74,76,79 and 81 to 83 have not filed counter affidavit depite grant of final opportunity on an earlier occasion. Respondent nos.38,43,47,50 and 61 are granted four weeks' time for filing counter affidavit.
Office report indicates that service report has not been received from the postal authority in respect of respondent nos. 1,9,10,13,21,26,39,44,46,55,67,72 and 80 despite issuance of notice upon the authority under directions of this Court. As such, issue D.O. to the Post Master General for ensuring that status report in respect of these registered articles are submitted within seven days of the receipt of the D.O.
Having heard ld. counsel for the petitioner at length, time of two weeks is also granted to the ld. counsel for the petitioner to take fresh steps and file fresh particulars, if any, for effecting service upon the said respondents. Dasti as prayed for is also allowed. However, service through the concerned District and Sessions Judge is also permitted, in terms of the submissions made by the ld. counsel for the petitioner that these proceedings originate from a land acquisition reference before that District Court in which all of these respondents were appearing as parties.
Service is complete on respondent nos.6,14,20,52,58,62, 65,66,71,75,77 and 78 but none has entered appearance on their behalf.
