UPON hearing the counsel the Court made the following O R D E R
We find it necessary to observe that the High Court ought to have taken a more sensitive approach to adjudicate the petitioner's application for condonation of delay of 61 days in filing the first appeal. Regardless of whether the applicant seeking condonation of delay is the State or a private party, the courts must construe "sufficient cause" for delay in a common sensical and pragmatic manner and not adopt a pedantic approach.
