The application for vacating stay in appeal abovementioned was listed before the Hon'ble Court on 307.2010, when the Court was pleased to pass the following Order:

"In this matter this Court vide order dated 20.04.2007 has directed stay of the impugned order till the disposal of the Appeal. This application has been filed by respondent Nos. 1 & 2 in the Appeal for vacating stay.

Issue notice.

Mr. B.K. Pal, learned counsel appearing for the appellants, accepts notice.

Four weeks' time is granted to file counter affidavit. Thereafter four weeks' time is granted to file rejoinder affidavit. List thereafter."

It is submitted that as directed above, notice in the aforesaid application was issued on 18.9.2010 to Appellant Nos. 1 & 2 through Mr. B.K.Pal, Advocate and to Respondent No. 3 by Regd. A.D. A.D. Card duly signed has been received from Respondent No.3 and Mr. Kh.Nobin Singh, Advocate has on 8.9.2010 filed vakalantama/appearance on behalf of Respondent No.3. Counsel for the appellants and Respondent No.3 have not filed counter affidavits in I.A., hence, no rejoinder.

There are three respondents in this appeal. Service of Notice of Lodgement of Petition of Appeal is complete on all the Respondents. Respondent Nos. 1 & 2 and 3 are represented by M/s Rajiv Mehta, and Kh.Nobin Singh Advocates respectively.

The appeal alongwith application above mentioned is listed before the Hon'ble Court with this office report.
