IN THE SUPREME COURT OF INDIA CIVIL APPELLATE JURISDICTION

MISCELLANEOUS APPLICATION NO. 411 OF 2024 IN CIVIL APPEAL NOS. 4870-4873 OF 2023

Reason:

S. SHRIRAM Applicant(s)

VERSUS

G. SAKTHI RAO & ORS. Respondent(s)

O R D E R

1. Heard Mr. Manan Kumar Mishra, learned senior counsel appearing for the applicant. Mr. D. Kumanan, learned counsel appears both for the State of Tamil Nadu and the Tamil Nadu Public Service Commission.

2. The learned counsel for the applicant points out that the applicant had appeared in the written examination conducted by the Tamil Nadu Public Service Commission in March, 2022 on Court's order. But his written results were not declared as the issue was whether his candidature should be considered under the 20% preferential quota, under the State of Persons studied in Tamil Medium Act (PSTM), 2010 (as amended).

3. Thereafter, on 22.01.2024, it was putforth by the candidate that he does not wish to claim consideration under the 20% preferential quota but he wants declaration of the results as a general category candidate who is not interested to seek preferential consideration. 4. Thereafter the applicant has filed the MA No. 411 of 2024 seeking declaration of the written examination and further if the applicant is successful, he may be permitted to participate in the interview segment of the recruitment test. It is submitted that the interviews are scheduled from 26.03.2024 to 28.03.2024.

5. Looking at the nature of the innocuous prayer and the categorical assertion by the applicant that he wants to be considered only as a general category candidate, the applicant's result in the written examination is ordered to be declared. If he is successful in the written examination, he may be permitted to also participate in the interview segment of the recruitment test.

6. With the above, the IA No. 37038 of 2024 and the miscellaneous application stand disposed of.

7. Pending application(s), if any, shall stand closed.
