Pursuant to this Court's Order dated 9.4.2012, show cause notice to respondent Nos. 1 to 3 was issued on 19.4.2012 by registered AD. Mr. Rajesh Srivastava, Advocate has filed vakalatnama/appearance as well as counter affidavit on behalf of respondent No. 1 and the same has been included in SLP Paper Books. AD card duly signed by respondent No. 3 has been received but no one has entered appearance so far. Unserved cover containing notice to respondent No. 2 has been received with postal remarks 'deceased'.

It is submitted that Lrs. of deceased respondent No. 2 i.e. respondent Nos. 2(b) to 2(d) have been brought on record vide Hon'ble Judge in Chamber Order dated 12.8.2013 and cause title has been amended accordingly. Respondent No. 2(a) is already on record as respondent No. 3. Service is complete on Lrs. of deceased respondent No. 2. However, no one has entered appearance so far.

For non-filing of appearance by Lrs. Of deceased respondent Nos. 2 and respondent No. 3, the matter was listed before the Court of Ld. Registrar on 2.1.2014, when the Court was pleased to pass the following order:-

"None for the petitioners.

The learned counsel for the respondent No.1 is present. The respondent No.1 has already filed the counter affidavit.

Service is complete as against the other respondents but no one has appeared on their behalf before this Court today. Viewed this appropriate steps for listing the matter before the Hon'ble Court on its own turn shall be taken by the Registry."
