Appeal admitted.

Recovery of the amount of compensation awarded against the appellant shall remain stayed subject to the following conditions:

1) The appellant shall not carry out any construction activity in the land in dispute.

2) The demolition orders, if any, passed by any authority shall not be affected by the pendency of these proceedings. The appellant shall however be free, if so advised, to seek appropriate redress in appropriate proceedings in accordance with law.

Accordingly, Notice of Lodgment of Petition of Appeal was issued to all the 14 common respondents on 22.08.2016 through National Green Tribunal, Principal Bench, New Delhi. Respondent Nos.1, 4 and 9 are represented through M/s. E.C. Agrawala, O.P. Bhadani and Anup Kumar, Advocates respectively but no counter affidavit has been filed so far. Certificate of service of Notice of Lodgment of Petition of Appeal is still awaited from the concerned Tribunal in respect of respondent Nos. 2-3, 5-8 and 10-14.

Service of notice is incomplete on respondent Nos. 2-3, 5-8 and 10-14. Appeal is not ready for hearing.

It is further submitted that Mr. Devashish Bharuka, Advocate for the appellant has on 10.08.2016 filed an application for modification of Court's Order dated 08.08.2016. The same has been registered as Interlocutory Application Nos. 4-5 of 2016.(Separate volumes are circulated herewith).

It is further submitted that IA Nos. 4 and 5 were mentioned before the Hon'ble Court on 22nd August,2016, when the Court was pleased to pass the following order:
