Learned counsel for the petitioner and learned counsel for the respondent No.1 are present.

From the perusal of the office report what comes to the fore is that two opportunities have already been granted to the respondents for filing the counter affidavit but despite that they have not filed the same so far. Keeping into consideration the requirement of the rules, no further opportunity is warranted to be given to them on that count and Item No.46 -2-

accordingly appropriate steps shall be taken by the Registry for listing this matter before the Hon'ble Court on its own turn.
