UPON hearing the counsel the Court made the following O R D E R
W.P.(C) No.797/2016 & W.P.(C) No.342/2017
Heard Mr. Shyam Divan, learned senior counsel for the petitioners and Mr. Tushar Mehta, learned Additional Solicitor General for the Union of India.
Mr. Tushar Mehta, learned Additional Solicitor General has prayed for some time on the ground that new facts have been stated in the rejoinder affidavit filed by the petitioner, which will have to be countered by the Union of India. The request for adjournment is not opposed by Mr. Divan, learned senior counsel for the petitioner, but he submits that in that case, the Court may clarify the position that the facilities which are provided under the Social Welfare Schemes to the persons who do or do not possess Aadhar card, should continue till the next date of hearing.
Mr. Mehta, learned Additional Solicitor General submits that no such clarification is required as the Office Memorandum dated 22nd June, 2017, extends the cut off date till 30th September, 2017, for persons who do not have the Aadhar number or Aadhar card. In view of this submission and the observations found in the judgment in case of Binoy Viswam vs. Union of India and Others [Writ Petition (C) No.247 of 2017] decided on 9th June, 2017, no further observation is required.
Let the sur rejoinder be filed on or before 4th July, 2017.
List the matter before the appropriate Bench on 7 th July, 2017.
