1. In view of the fresh timeline having been granted to the NCT of Delhi and its authorities by a three-Judge Bench of this Court in Delhi Development Authority vs. Tejpal & Ors.,(2024) SCC Online SC 1091, for acquisition of such land where acquisition proceedings had been declared to have lapsed in terms of Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the prayer in the instant Miscellaneous Application has been rendered infructuous.

2. M.A. stands disposed of accordingly.

3. On an oral prayer, RP (C) No.399/2023 is ordered to be listed for hearing on 25.09.2024 before a three-Judge Bench comprising of Hon'ble Mr.Justice Surya Kant, Hon'ble Mr.Justice Dipankar Datta and Hon'ble Mr.Justice Ujjal Bhuyan.

UPON hearing the counsel the Court made the following O R D E R

R.P.(C) No.882/2017 In C.A. No.11846/2016

1. The Delhi Development Authority through a responsible officer is directed to file an affidavit explaining (i) Whether 80% compensation amount was offered while invoking Urgency Clause under Section 17 of the Land Acquisition Act, 1894? (ii) If so, what was the mode of offering the compensation? (iii) Whether subsequently any award was passed? If not, what was the legal impediment in passing of the award? (iv) Whether possession of the acquired land was taken and, if so, on which date and what was the mode of taking it?

2. The needful shall be done within two weeks.

3. List on 25.09.2024 before a three-Judge Bench comprising of Hon'ble Mr.Justice Surya Kant, Hon'ble Mr.Justice Dipankar Datta and Hon'ble Mr.Justice Ujjal Bhuyan.
