UPON hearing counsel the Court made the following ORDER

In view of the averment in para 1 (a) of SLP regarding respondent No.2, which is in fact petitioner in this SLP, but since the name as petitioner and as respondent No.2 are different, petitioner has disclosed the name of respondent No.2, as per the name disclosed in the cause title in the impugned order, hence no notice is necessary upon respondent No.2. Such fact is disclosed by the learned Counsel for the petitioner by letter dated 5-2-2009.

Respondent No.1 has filed counter affidavit. Petitioner has disclosed respondent No.2 as a proforma respondent. Learned Advocate appearing for the respondent No.2 states that they want to file counter affidavit and seeks time for the purpose. They may file counter affidavit before the date of listing as per Rule. Registry has to take appropriate steps as per Rules.
