IA Nos. 15-16 of 2015 in SLP(Civil) Nos. 14625-14626 of 2015
We are informed that under the Bihar, Civil Service Judicial Branch(Recruitment) Rules, 1955, candidates belonging to the Scheduled Castes and Scheduled Tribes are given a relaxation of 5 years above the upper age limit of 35 years seeking employment under the said rules. Inspite of the said rule, it is admitted on all hands that the High Court had, on the administrative side, passed a Resolution that the relaxation be confined to 3 years and not beyond. We are informed that the legality of the above-mentioned Rules is not challenged in any of the matters.
The Resolution of the High Court dated 18th September, 2010 is plainly inconsistent with law and therefore, the applications are allowed as prayed for.
List all the matters on 12th July, 2016 as first part heard.
