UPON hearing the counsel the Court made the following O R D E R
The second affidavit filed on behalf of the concerned officer also cannot be said to be an affidavit tendering unconditional apology for disobedience of the judgment and order passed by this Court. Digitally signed by R Natarajan Date: 2022.04.19 16:53:44 IST Reason: Signature Not Verified
It is to be noted that earlier a compliance report along with the affidavit was filed affirmed by the concerned officer. However, it was pointed out that the judgment and order passed by this Court has not been complied with in true spirit and in toto. Thereafter, the subsequent affidavit is filed in which it was pointed out that a corrigendum has been issued. Meaning thereby, the earlier affidavit submitting the compliance report was false and incorrect and, therefore, a very serious view is to be taken.
Shri K.M. Nataraj, learned ASG, has stated that the concerned officer is present in the Court. A further affidavit shall be filed by tomorrow i.e. 20.04.2022.
Learned counsel appearing on behalf of the petitioners has submitted that, even by corrigendum also, it cannot be said that the judgment and order passed by this Court has been fully implemented.
We request the learned ASG to again look into the matter otherwise the matter will be viewed very seriously.
Let the concerned officer also remain present before the Court tomorrow also.
