UPON hearing the counsel the Court made the following O R D E R

These applications pertain to the resumption of mining by the applicant (M/s.Essel Mining And Industries Ltd.).

The applicant is the mining lease holder in respect of the mines at Jilling-Langalotta, Koira and Kasia. These applications pertain only to the Jilling-Langalotta and Koira mines.

It is stated by learned counsel for the applicant and this is not in dispute that whatever amounts are due in terms of the judgment of this Court dated 2nd August, 2017 along with interest with regard to the Jilling-Langalotta, Koira and Kasia mines have been paid. There was some delay in making the payment and that delay was attributable to the fact that the demand notice was issued on 26th December, 2017. For this reason, we did not require the applicant to pay interest on the delayed payment.

Under these circumstances, the State of Odisha may permit the applicant to resume mining in the Jilling-Langalotta and Koira mines.

Learned counsel for the applicant says that insofar as the Kasia mines is concerned all clearances have not yet been obtained and, therefore, the question of permitting resumption of mining in Kasia mines does not arise for the present.

Both the applications stand disposed of.

This is an application filed by M/S Patnaik Minerals Pvt. Ltd.

It is stated that there is a delay of 31 days in making the payment due to the State Government in terms of the judgment dated 2nd August, 2017.

Learned counsel for the applicant says that the entire amount due has been paid along with interest. He prays that the delay in making payment may be condoned in view of the fact that the interest amount has been paid.

Keeping this in mind, we condone the delay in making the payment.

Application stands disposed of.
