UPON hearing the counsel the Court made the following O R D E R

1 Mr Sidharth Luthra, learned Senior Counsel appearing on behalf of the second respondent, on caveat, has adverted to a compilation which has been circulated by Ms Supriya Juneja, Advocate-on-record, which contains, inter alia, a copy of the order dated 19 March 2021 of the Judicial Magistrate First Class, Faridabad. The order dated 19 March 2021 reads as follows:

"Complainant Dr. S.S. Bansal appeared today alongwith his counsel.

From the perusal of the case file, it is revealed that the cancellation report arising out of FIR No.765 of 2018, P.S. Central, Faridabad was submitted by the in-charge police station on 15.2.2021.

On being asked by this court – whether he is satisfied with the cancellation report, the complainant Dr. S.S. Bansal, orally answered in negative.

In the backdrop of his statement, he is at liberty to file the protest petition.

On the sidelines, an application for supply of complete set of cancellation report and for providing sufficient time to file appropriate application/protection petition filed by learned counsel for the complainant.

In view of the aforesaid application, the application in hand, in the interest of justice, is hereby allowed and accordingly, the concerned Ahlmad is directed to supply the certified copy of the aforesaid documents as per the rules to the complainant.

Sequally (sic) to come upon 28.5.2021 for the consideration on the point of police report – whether to accept it, reject it or issue any direction for the further investigation into the case.

However, both the accused are hereby directed to appear before this court as and when directed to answer the queries, which may be posed to them by this court at the time of the consideration of the cancellation report."

2 Since the closure report has been filed before the competent Court, we are not

entertaining the Special Leave Petition, at the present stage, leaving the parties

at liberty to pursue their remedies in accordance with law.

  • 3 Subject to the aforesaid, the Special Leave Petition is dismissed.
  • 4 Pending application, if any, stands disposed of.
