O R D E R

Having heard learned counsel appearing for the parties, we see no reason to interfere with the impugned orders passed by the Appellate Tribunal for Electricity, New Delhi. However, we make it clear that the appellant would be entitled to approach the Commission for any changes which are proposed to be made in the Power Purchase Agreement (PPA).

We further make it clear that the changes cannot be made in the PPA after the draft proposed PPA is approved by the Commission.

Having regard to the facts and circumstances, it would be appropriate for the Commission to dispose of any such application(s) as expeditiously as possible.

Ordered accordingly.

With the aforesaid observations, the instant appeals are disposed of.

Pending interlocutory applications, if any, stand disposed of.
