UPON hearing the counsel the court made the following O R D E R

1. Issue notice.

• 2. Mr. Harshad V. Hameed, learned Advocate on Record who is on caveat accepts notice.
• 3. Counter affidavit, if any, be filed within four weeks. Rejoinder

affidavit, if any, be filed within four weeks, thereafter.

4. In the meantime, the operation of the impugned order entitling the respondent No.1 to pension from the date of his retirement, i.e. 30th November, 2014 shall remain stayed. However, it is clarified that the respondent No.1 shall be entitled to the pension on a month to month basis w.e.f. 01st July, 2020 onwards.

5. List after pleadings are complete.
