UPON hearing the counsel the Court made the following O R D E R
Mr. U.P. Singh who is holding additional charge as Secretary, Labour in the Government of India is present in the Court today pursuant to our order dated 1.05.2018.
It is stated that an Office Memorandum has been issued on 24.04.2018 constituting a Committee for formulation of an Action Plan and a Model Scheme for Welfare of building and other construction workers. The composition of the Committee is as follows:
1. Joint Secretary and Director General (Labour Welfare) Chairman
2. Region-wise Representatives from the State Governments
(i) North – Principal Secretary, Labour, Govt. of Uttar Pradesh Member (ii) South - Principal Secretary, Labour, Govt. of Telangana Member (iii) East – Principal Secretary, labour, Govt. of Odisha Member (iv) West – Principal Secretary, Labour, Govt. of Maharashtra Member (v) North East – Principal Secretary, Labour, Govt.of Assam Member
3. A representative of Bhartiya Mazdoor Sangh
4. A representative of CREDAI
5. A representative of National Campaign Committee for Central Legislation on Construction Labour
6. A representative of ILO
The Committee has been advised to submit a draft report in one
month's time from the date of its constitution. That time expires on 24.05.2018.
We expect the Committee to adhere to the schedule considering that the amount involved in this case is about Rs.30,000 crores which is due to poor people who are engaged in building and other construction work. Therefore, there has to be some urgency in the matter and the entire exercise cannot be taken up in a casual manner. The draft report must be completed positively on or before 1 st June, 2018.
It is further stated that the draft Model Scheme for the welfare of building and construction workers is almost ready and is likely to be circulated to the stake holders within this week.
We have advised Mr. Singh to place it on the portal of the Ministry of Labour so that comments can be invited from the general public as well.
List the matter on 3rd July, 2018 for compliance.
The Secretary, Labour need not be present in the Court on the next date of hearing.
