1. Heard the learned counsel appearing for the parties.
2. The office report records that notice has been served on the sole respondent. None appears for the respondent.
3. The petitioner is the wife and the respondent is the husband. The petitioner is a resident of Bengaluru, Karnataka and the respondent is a resident of Powai, Mumbai.
4. The prayer in this petition is for transfer of the petition for divorce filed by the respondent – husband in the Family Court, Mumbai, Maharashtra.
5. The ground pleaded in the petition is that the petitioner is a resident of Bengaluru, Karnataka. She has to look after three years old daughter and, therefore, she finds it very difficult to attend the proceedings in Mumbai, Maharashtra.
**6. In view of the grounds stated, a case is made out for transfer. Accordingly, the Transfer Petition is allowed. The MJ Petition No.326 of 2020 titled as "**Mr. Vijay Shivshnakar Hiremath Digitally signed by Indu Marwah Date: 2022.04.13 10:13:20 IST Reason:
Vs. Mrs. Namitha Vijay Hiremath & Anr." pending before the Family Court, Mumbai at Bandra, Maharashtra is hereby transferred to the Family Court, Bengaluru, Karnataka. It is directed that the records relating to MJ Petition No.326 of 2020 shall be remitted forthwith to the Family Court, Bengaluru, Karnataka.
The petition is accordingly disposed of.
