Leave granted.
Heard the learned counsel for the appellant as well as learned counsel for the first respondent State of Punjab. Though respondent Nos.2 & 3 are served, they have not appeared before this Court. They were summoned to appear in Session Case No.41 of 2008 registered under Sections 365/306 of the Indian Penal Code. The appellant is the brother of the deceased young lady and it is the mother-in-law and sister-in-law who are respondent Nos.2 & 3 herein who have been summoned to appear under Section 319 of the Cr.P.C. They having challenged that order the High Court has set aside the summoning order. Counsel has taken us through the material on record and we do not see any error in the summoning of the respondent Nos.2 & 3 to the Court. In the circumstances, the aforesaid submissions are accepted and the order of the High Court is set aside and the summoning order is restored. The appeal is allowed as above.
