The matters above-mentioned were listed before the Hon'ble Court on 23.01.2017 with office report dated 21.01.2017, when the Court was pleased to pass the following Order:

"We have been apprised at the Bar that the State of Maharashtra and the State of Madhya Pradesh are necessary parties. Let them be impleaded as respondent Nos.5 and 6. Cause title be rectified accordingly.

Mr. C.D. Singh and Mr. Nishant Katneshwarkar, learned counsel, undertake to appear on behalf of the States of Madhya Pradesh and Maharashtra respectively and shall file their respective affidavits with regard to interim relief within two weeks hence.

Mr. Anupam Lal Das, learned counsel who has entered appearance on behalf of the Western Coal Fields, the respondent No.4, undertakes to file affidavit within two weeks hence.

Let the matter be listed for consideration of interim relief on 7th February, 2017."

It is submitted that pursuant to the aforesaid order dated 23.01.2017, cause title has been amended and copy of the same is being circulated herewith.

It is further submitted that pursuant to the aforesaid order dated 23.01.2017, Mr. Anupam Lal Das, Advocate has on 06.02.2017 filed short counter affidavit on behalf respondent No. 4 in both the writ petitions above-mentioned (copies of the same as separate paper books are being circulated herewith).

It is further submitted that pursuant to the aforesaid order dated 23.01.2017, Mr. C.D. Singh, Advocate has on 09.02.2017 filed reply affidavit on behalf of State of Madhya Pradesh in W.P.(C) No. 886 of 2016 (copy of the same as separate paper books is being circulated herewith).

It is further submitted that no other documents have been filed so far.

"Issue notice on the writ petition, as also on the prayer for interim relief, returnable within four weeks. As Mr. Maninder Sinsh, learned Additional Solicitor General has entered appearance on behalf of the Union of India, no notice need be issued to the said respondent. Tag with W.P.(C) No.886 of 2016."

It is submitted that pursuant to the aforesaid order, show cause notice was issued to respondent nos. 2 and 3 by speed post and to respondent no. 4 through Mr. Anupam Lal Das, Advocate on

It is further submitted that pursuant to the aforesaid order, Mr. Anupam Lal Das, Advocate has on 06.02.2017 filed short counter affidavit on behalf respondent No. 4 (copy of the same as separate paper books is being circulated herewith).

It is further submitted that counsel for the petitioner has on 01.02.2017 filed an application for permission to implead the State of Maharashtra and the State of Madhya Pradesh as party respondents in the instant writ petition. However, Advocate has mentioned in the para 2 and 3 of the supporting affidavit that annexures are true and correct copies of its original but no annexures have been annexed with the application. Hence, the unregistered application for permission to implead as party respondent is being circulated herewith.

Service of notice is awaited in respect of respondent nos. 2 and 3.

The Writ Petitions alongwith applications above-mentioned are listed before the Hon'ble Court with this Office Report.
