The Transfer Petitions above mentioned anlongwith Connected matters were listed before the Hon'ble Court on 16th September, 2015 when the Court was pleased to pass the following Order:
"A grievance has been pointed out by Ms. Tamta, learned counsel appearing for the Union of India that copies of certain transferred cases have not been served on her.
Be that as it may, she shall intimate the Advocates-on-Record in the transferred cases wherein she has not been served and the Advocates-on-Record shall supply the copies as per Rules within three days from the date of communication. She has agreed to send a communication within two days. Needless to say, no counter affidavit is required to be filed as the special leave petition filed by the Union of India would sub-serve the purpose of counter affidavit. We may reiterate, at the cost of repetition, that in this batch of cases, a pure question of law arises, though arguments can be canvassed from many an angle or many a foundation.
Let the matter be listed on 14.10.2015."
It is submitted that counsel for the parties have filed proof of serving the copies of Writ Petitions on Ms. Binu Tamta, Advocate in Transferred Case Nos. 89/2014, 35 to 37, 40 and 61 of 2015 but have not filed proof of serving the Writ Petition to Ms. Binu Tamta in T.C. Nos. 88 of 2014, 23, 24, 26 to 28, 30, 31 to 33 of 2015.
It is submitted that certificate of service has not been received from the High Court in T.P (C) 1369 to 1371 of 2014 despite reminder dated 10th August, 2015.
It is further submitted that status reports have been received from High Court's stating that W.P (C) 4412 of 2012 (T.P (C) 1369 of 2014), W.P (C) 6107 of 2012 i.e, (T.P (C) 1370/2014) W.P (C) 5588 of 2012 i.e, (T.P (C) 1371 of 2014) and W.P (C) 56656 of 2013 i.e, (T.P (C) 1377 of 2014) are still pending before High Court.
Service of notice is complete in 1377/2014 and Service of notice is incomplete in T.P.
(C) 1369, 1370 & 1371/2014.
Service is complete in all the Transferred Cases.
Since the main matter i.e, SLP (C) No. 15937 of 2014 is on board, Hence, the matters above-mentioned are listed before the Hon'ble Court with this Office Report.
