The appeals abovementioned were listed before the Registrar's Court on 28.10.2016, when the following Order was passed:
"Legal representative Nos. 1A, 1B, 1D, 1E, legal representative Nos. 1 to 3 of deceased legal representative No. 1C are duly represented.
None appears for legal representative Nos. 3(i) to 3(viii) despite due service.
Last opportunity of two weeks is granted for taking appropriate steps in respect of respondent no. 2.
Registry immediately thereafter to process under rules, whether steps are taken or not."
It is submitted that a letter dated 02.09.2016 has been received from the Rajasthan High Court, Jaipur, stating therein that respondent No. 2 viz. Smt. Srinagar Kanwar (Common in both the matters) had died twenty five years ago. (Copy of the letter dated 02.09.2016 is enclosed herewith) but Counsel for the Appellant has not taken appropriate steps in respect of the said respondent No. 2 so far.
Service is incomplete on common respondent No. 2 in both the matters.
The default of the Advocate is reported before the Hon'ble Judgeinchambers with this Office Report.
