The matter abovementioned was listed before the Hon'ble Court on 4th March, 2016, when the Court was pleased to pass the following order:

"Delay condoned.

Issue notice.

As an adinterim measure, it is directed that the petitioner shall deposit a sum of Rs.10,000/ (Rupees ten thousand) before the Family Court, Darbhanga, Bihar, towardsthe litigation expenses. The respondent No.2wife will be at liberty to withdraw the same. The deposit shall be made within two weeks hence.

The Family Court, after the deposition of the aforesaid amount, shall intimate the respondentwife so that she can withdraw the amount and contest the present lis.

The Registry is directed to fix a returnable date within six weeks."

Pursuant to the order show cause notice was issued to the all four respondents by registered A.D.Post. M/s Abhinav Mukerji and Dushyant Parashar, Advocates has filed vakalatnama/appearance on behalf of respondent nos. 1 & 2 respectively. Counsel appearing for respondent no.2 has also filed counter affidavit and the same has been included in the Special Leave Petition paper books. Neither A.D.Card nor unserved cover containing show cause notice received back from respondent nos. 3 & 4, so far.

It is further submitted that the matter abovementioned was mentioned before the Hon'ble Court on 11th January, 2017, when the Court was pleased to pass the following order:

"On being mentioned, the matter is taken on Board.

List the matter on 23.01.2017."

Service of show casue notice is not complete in respect of respondent nos. 3 & 4.

The matter abovementioned is, therefore, listed before the Hon'ble Court with this office report.
