UPON hearing the counsel the Court made the following O R D E R
Mr. Ranjit Kumar, learned senior counsel appearing for the appellant(s), has drawn our attention to Order dated 07.05.2018 whereby this Court had recorded the statement of learned Additional Solicitor General that Government of India is likely to take final decision in the matter within three months from the said date. He has also drawn our attention to letter dated 10.08.2015 of the
3
Ministry of Coal, in this behalf.
It appears that final decision has not been taken so far. Mr. A.N.S. Nadkarni, learned Additional Solicitor General, informs that some information was called for from the State of Meghalaya. Though, it was initially furnished, however, in December, 2018, another letter was written by Government of India to the State of Meghalaya for furnishing some more information. Learned counsel appearing for the State of Meghalaya responds by saying that the said information has also been provided. In view thereof, we expect the Government of India to take a final decision within one month.
Various Interlocutory Applications have been filed for transportation of the coal already mined. Mr. Shekhar Naphade, learned senior counsel appearing for the State of Meghalaya, has stated at the Bar that the State Government has constituted a Committee in this behalf, for the entire State, to study various aspects of this matter and the Government of Meghalaya would be in a position to file the response after receiving the report from the said Committee. He also submits that this exercise may take one month. State of Meghalaya, in these circumstances, file its response within four weeks from today. The applicants can make their representation before the said Committee in writing.
List on 26.03.2019.
