The matter above mentioned was listed before the Hon'ble Court on 24.02.2014, when the Court was pleased to pass the following order:
" Issue notice to the respondents, returnable after four weeks."
Accordingly, show cause notice to both the respondents was issued through registered A.D. Post on 11.03.2014. A.D. Card duly signed has been received back from Respondent No. 2 but no one has entered appearance on his behalf. Neither A.D. card nor unserved cover containing notice has been received back in respect of Respondent No. 1.
It is submitted that for completion of service on Respondent No. 1, the matter was listed time and again before the Ld. Registrar's Court and lastly on 16.10.2015, when the following Order was passed:
" Respondent No.1 has yet not been served for want of any steps to be taken by the petitioner, despite the effective opportunities given for the purpose. The matter be placed before the Hon'ble Judge in Chambers for further directions.
Service of respondent No.2 is complete but none has entered appearance."
It is submitted that Counsel for the petitioner has not taken fresh steps to effect service upon respondent No. 1 so far.
The office report on default is listed before the Hon'ble Court (In Chambers).
