UPON hearing the counsel the Court made the following O R D E R
The affidavit of respondent No.107 dated 17.1.2022 has been perused. The affidavit shows that after the Ministry of chemical and fertilizers/ petitioner had granted in
principle approval to formulate a scheme for making payment of pay revision arrears from 1.1.1997 to 30.6.2021 a draft scheme was formulated and after obtaining the approval of the Board of Directors the same was forwarded to the Ministry. The Ministry examined the scheme and vide its letter dated 23.11.2021 directed to modify the scheme and submit it back with the approval of Board of Directors. This was complied with in the Board of Directors meeting held on 08.12.2021 and the scheme was forwarded on 13.12.2021. Once again the Department of Fertilizers suggested certain modifications and directed to submit the modified scheme for approval which has also been forwarded on 14.1.2022.
We would like to place on record that we do not appreciate the repeated sending back of the scheme by the Ministry and all that should have been done at one go. Be that as it may, we expect the necessary approval of the Ministry by the next date, failing which, we will have to have the assistance of the Secretary concerned.
