when the Court was pleased to pass the following Order:

"Permission to file additional documents is granted. Delay condoned. Issue notice. Tag with SLP(C) No. 5541 of 2014."

Accordingly, show cause notice was issued on both the Respondent on 21.11.2014 through Registered Post. Mr. Naveen R. Nath, Advocate has filed vakalatnama/appearance in respect of the Respondent No. 1. A.D Card duly signed has been received in respect of Respondent No. 2 but no one has entered vakalatnama/appearance so far.

The matter above mentioned was listed before the Registrar Court from time to time and when lastly listed on 03.08.2015, the following Order was passed:

"The office report indicates that the Respondent No. 1 has failed to file the counter affidavit within the period stipulated under the rules. Service of notice is complete on the respondent No. 2 but no one has entered appearance on his behalf. Viewed, in that context, the matter shall be processed for listing before the Hon'ble Court, under the rule."

It is submitted that Mr. Naveen R. Nath, Advocate has on 17.10.2016 filed counter affidavit on behalf of Respondent No.1 and the same is being circulated with this office report.

Service of show cause notice is complete.
